Food Business Operators (FBOs) Who Require FSSAI Registration

The FBOs carrying on the following kinds of business are mandatorily required to obtain an FSSAI Registration/License:

  • Petty retailers and retail shops such as Retail Shop, Snacks shop, Confectionery or Bakery Shop, etc.
    • Temporary stalls or fixed stall or food premise involved in the preparation, distribution, storage and sale of food products such as Gol Gappa stall, chat stall, fruits/vegetable vendors, Tea Stall, snacks stall, Bread pakoda stall, Samosa stall, Chinese food stall, South Indian food stall, sweet stall, juice shops, etc.
    • Hawkers who sell packaged or freshly prepared food by travelling (usually on foot or movable carts) from one location to another.
    • Dairy Units including Milk Chilling Units, Petty Milkman and Milk Vendors.
    • Vegetable Oil Processing Units.
    • Slaughtering houses such as meat shops, mutton shops, chicken shops, lamb meat, etc.
    • Meat Processing and Fish Processing units.
    • All Food Manufacturing/ Processing units that include Repacking of food.

    CATEGORY 1:

    Documents Required for FSSAI Registration (Basic)

    1. Authorized person address proof

    2. Passport size photo

    3. Business Name and Address

    4. Form A duly completed and signed by the Proprietor/ Partner or the Authorised Personnel

    CATEGORY 2:

    Documents Required for FSSAI Registration (State License)

    1. Rental Agreement of Business Premises.

    2. Valid ID Proof of the Authorized Person (Aadhaar Card / Driving License / Passport / Voter ID)

    3. Government Registration Certificates wherever applicable (Company Incorporation Certificate / Firm Registration / Partnership Deed / Pan card / GST Registration Number / Shop and Establishment Registration / Trade License)

    4. If the applicant is a private limited company or partnership firm then they should provide MOA (Memorandum of Association) & AOA (Article of Association) or Partnership Deed Copy

    5. For applying for State License, any one of the following certificates is compulsory: (Trade license, Panchayat License, Corporation License, Municipality License)

    6. List of Food Categories desired to be manufactured (only for manufacturers)

    7. Form B duly completed and signed by the Proprietor/ Partner or the Authorized Personnel

      Procedure for Obtaining FSSAI Registration Online

      • FBOs can obtain FSSAI registration online by filling and submitting the FSSAI registration form, i.e., Form A (application for Registration) or Form B (application for State and Central License) on the Fosco's portalThe FBOs can also register offline by submitting Form A or Form B to the Food and Safety Department.
      • The FSSAI registration form must be accompanied by the required documents. The documents must be uploaded online on the Fosco's portal at the time of filling the application or submitted to the Food and Safety Department along with the application physically.
      • The FSSAI registration form can be accepted, or it may be rejected by the Department within 7 days from the date of receipt of an application either physically or online through the Foscos' portal. If the application is rejected it has to be intimated to the applicant in writing.
      • The Department will scrutinize the documents submitted.
      • The Department may conduct an inspection of the food premises, before granting the FSSAI registration certificate, if necessary.
      • If the Department is satisfied that the FBO meets all the required criteria, then it will grant an FSSAI registration certificate with the registration number and the photo of the applicant email ID. The applicant can also download the FSSAI registration certificate by logging into the Fosco's portal.
      • FBO should prominently display the certificate of FSSAI registration at the place of business during business hours.

      FSSAI Registration Eligibility

      FSSAI Registration is a basic license, and it is required for all the FBOs involved in the small-scale food business. This category covers the following businesses:

      • Any FBO with an annual turnover of not more than Rs. 12 lakhs.
      • Petty retailer dealing in food products.
      • Any person who manufactures or sells any food article by himself.
      • Food sale is done by the temporary stall holder.
      • Any individual who distributes food in any religious or social gathering except a caterer.

      How to download the FSSAI registration certificate from the Fosco's portal?

      When the FSSAI authorities issue the FSSAI registration certificate, they will send the certificate on the mail ID of the FBOs. The FBOs can also download the FSSAI registration certificate by logging into the Fosco's website and clicking on the ‘Issued’ tab on the dashboard.

      What details are mentioned on the FSSAI registration certificate?

      The FSSAI registration certificate will contain the name and address of the FBO, address of the food business premises, kind of business and the period of validity. 

      What is the FSSAI License validity period in India?

      An FSSAI license can be acquired for a period ranging anywhere from 1 year to 5 years. The FSSAI has prescribed different validity periods for different licenses and food products. Your fee also varies according to the food license and the validity period.

      How to renew your registration/license after expiry?

      You need to renew your FSSAI Registration/license before the expiry of its validity period. In case you end up missing the date of renewal of the application, you will have to apply for a fresh FSSAI license if you wish to continue your food business operations.

      Can I convert a manually issued license to online? How?

      Yes, you can convert a manually issued license to an online one during the renewal process. You can approach the concerned designated officer of that area. A designated officer can then create a User id and issue a system-generated license number which can be renewed through an online process to you.

      What are the different categories of license?

      The FSS (Licensing & Registration) Regulations, 2011, licenses and registrations are granted to Food Business Operators in a 3 tier system based on the turnover and food manufacturing capacity limit. The three licenses are – FSSAI Basic Registration, FSSAI State license and FSSAI Central License.

      If medical stores are selling dietary food, do they need to get a license for selling dietary foods and or plant-based supplements (nutraceuticals)?

      All Food Business Operators and, including medical stores, have to get FSSAI license/registration. It is mandatory, and non-compliance may result in heavy penalties.

      Can a license be modified? What is the fee for such modification?

      If you intend to make changes to your license, you can do so. If you wish to make changes to the information in the FSSAI license, you can do so by filing the application for modification. A modification fee may apply which is equal to a one-year license fee. There are no charges levied for changes to other parts of the license.

      What is improvement notice and who issues it?

      An improvement notice is if a Food Business Operator fails to comply with the food regulations set in the FSS Act, 2006. An improvement notice can be issued by a Designated Officer (DO) of the food safety department.

      When can an FSSAI Designated Officer (DO) suspend the license?

      If the food business operator has failed to comply with an improvement notice, his/her licence can be suspended by the FSSAI Designated Officer (DO), after allowing him/her to show cause.

      Can an appeal be filed against an Improvement notice, suspension/ cancellation of license?

      Yes, any Food Business Operator (FBO) can appeal to the State Commissioner of Food Safety, if he/she is aggrieved by the improvement notice or suspension/cancellation of licence. The decision of the Food and Safety Commissioner shall be final. Alternatively, an FBO can also approach the Food Safety Appellate Tribunal/ High Court of their respective States/UTs to challenge the notice.
